| AS A VALUED CUSTOMER OF AWI STYLING WE AIM TO MAKE YOUR STYLING EXPERIENCE AS ENJOYABLE AND HASSLE FREE AS POSSIBLE. At AWI Styling we try to keep things simple with clear and open guidelines to avoid misunderstandings with our customers. Therefore, we have devised our own approach. If you have problems you will want to know how they will be resolved and where you stand. We want to avoid potentially difficult situations and surprises for you. We have built our business on reputation and loyal customers and we want to ensure that you are satisfied with the ‘AWI Styling promise’. Through reading these terms and conditions misunderstandings will be avoided. TERMS AND CONDITIONS – PLEASE READ THEM IN FULL BEFORE PURCHASING!!!!! PLEASE READ THIS FULL DOCUMENT CAREFULLY BEFORE ACCESSING OR USING THE SITE. BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET OUT BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT PLACE AN ORDER WITH US. AWI STYLING MAY MODIFY THIS AGREEMENT AT ANY TIME, AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING OF THE MODIFIED AGREEMENT ON THE SITE. YOU AGREE TO REVIEW THE AGREEMENT PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR CONTINUED ACCESS OR USE OF THE SITE SHALL BE DEEMED YOUR CONCLUSIVE ACCEPTANCE OF THE MODIFIED AGREEMENT. ACCEPTANCE OF GOODS SHALL BE DEEMED TO BE ACCEPTANCE OF THESE CONDITIONS OF SALE. ANY TERM SOUGHT TO BE IMPOSED BY A PURCHASER EITHER IN A DOCUMENT OR OTHERWISE THAT CONFLICTS WITH OR ADDS TO THESE CONDITIONS IS NOT ACCEPTED AND WILL NOT BECOME A TERM OF THE CONTRACT. 1. COPYRIGHTS/TRADEMARKS All content included on this site, such as text, graphics, logos, button icons, images, audio clips and software, is the property of AWI Styling or its suppliers and protected by UK and international copyright laws. Any unauthorised use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal and/or civil penalties. All software used on this site is the property AWI Styling or its software suppliers and protected by UK and international copyright laws and may not be reproduced, modified, distributed, transmitted, or republished without written permission. AWI Styling and all titles, characters, names, graphics and icons are service marks, trademarks, and/or trade dress of AWI Styling. All other trademarks, product names and company names or logos herein are the property of their respective owners. AWI Styling is a trading name of ALLOY WHEELS INTERNATIONAL., MILL STREET COURT, NEWTOWNARDS, CO DOWN, N.IRELAND. 2. HOW CAN I PAY? PAYMENT TERMS AND PRICES Payment is easy and can be made over the phone. We accept a range of payment options including all major credit and debit cards. All customers must pre-pay for all products. We will accept money orders, personal cheques, credit & debit cards, BACS payments or other direct transfers to our bank account (details can be supplied on request). All personal/company cheqes must clear before goods are dispatched. All credit and debit card transactions will take 48 hours to receive authorisation that funds have cleared into our account. Please note that we are unable to release products until your payment has been received in full (cleared). AWI Styling reserves the right to vary the quoted price of the goods by such an amount to reflect with the market conditions at the date of actual supply and the purchaser shall pay such additional amount as well as the quoted price. Price Lists are provided as a guide only and do not constitute an offer. No contract exists between you and AWI Styling for the sale of any goods until we have received and accepted your order and we have also received your cleared payment in full. Once we have received the payment in full (cleared funds), and excepted the order, there is a binding legal contract between us. 3. PROPERTY AND RISK – If I haven’t paid for the order in full or the payment hasn’t cleared who owns the products? In short the answer is AWI styling. As long as any amounts remain owing from you (the purchaser) to AWI Styling (whether immediately due or not) title to the property of the goods shall remain in AWI Styling and ownership will not pass to the purchaser until we have received full payment (cleared). In the event of the purchaser purporting to sell the goods, to another, where we have not received all amounts outstanding you shall account to AWI Styling for the proceeds of your total order. We will hold all proceeds of your total order in trust until we have received the outstanding balance in full (cleared). AWI Styling shall have the right to trace all proceeds. AWI Styling should have the right to chase such proceeds of any such transaction. 4. DISPATCH – I have paid you. How fast can you dispatch my order? Items paid in cash can normally be dispatched the same day. However, please note that the packaging dispatch deadline is 1.00 pm for a next working day service. As a general rule d to receive payment in full cleared before 1.00 pm to benefit from a next day delivery service. As a general rule we will aim to dispatch all items within 48 hours of receiving cleared funds from you. Please note that if you pay by credit or debit cards please allow 48 hours for the funds to be cleared into our account. AWI Styling cannot be held responsible for any delays in payment by any third party service provider. AWI Styling cannot be held responsible for any delays in transit or distribution due to any third party carrier. Please note that whilst every effort will be made to achieve our stated aim AWI Styling cannot guarantee delivery times. Mail delivery’s please give 14 days in case of lost or damaged goods. 5. Prices : Prices Shown DO NOT include Packaging and Posting! All items are priced exclusive of packaging and posting. Please note that there are various posting options available which will have different price tariffs. Written price quotes are available on request. Various delivery service options are available. Please ring for details. 6. RETURNS AND REFUNDS – CHARGES AND RESTOCK FEES MAY APPLY! i. My order is damaged what do I do? All returns must be authorised and approved by AWI Styling and are subject to a 20% restocking fee. Please call us immediately on 07745549140. All return requests must be made within 24 hours after receiving the goods. Any request to return a product after 48 hours from the day of receipt will not be authorised. ii. Responsibility for approved returns All approved returns must be returned to AWI Styling,41 MILL STREET COURT, NEWTOWNARDS CO DOWN BT234JE in unused and unaltered condition with original packaging (or better packaging). Insure that product is very well packaged. It is your responsibility as the sender if the item(s) is lost during transit to us, so please use adequate postage services and tracking facilities such as Royal Mail Special Delivery. Any variation of this return surcharge shall be at the sole discretion of AWI Styling. iii. Refunds will not be issued in the following circumstances : Refunds will not be issued if there is evidence to suggest that there has been an attempt to paint, fit or alter the returned items. This is solely down to the discretion of AWI Styling. Refunds will not be issued on returns that are damaged during shipping back to AWI Styling. In the event that damage does occur, a refund will be issued when a claim has been settled with the carrier. Failure to comply with this return policy will result in a refusal of the shipment and will be returned to customer at his/her own expense. We only charge for costs incurred, such as bank fees and postage fees etc. If you order the wrong part for your vehicle there will be no refund. iv. Payment of the refund – When do I get it? Once we have received the package a balance payment will be made to the customer less, the 20% surcharge and all other associated costs as indicated under the terms of the returns policy. Items returned within 7 days of receipt, which haven't been opened or used will get a 100% refund as denoted by general UK law as long it has been previously approved by AWI Styling. We reserve the sole discretionary right as to whether to accept the return of the goods or whether to rectify the goods or whether to issue a credit note in respect thereof. Returns will only be accepted if the goods are in new, unused, unfitted, unpainted condition. . Please Note Carefully: - The customer will be required to pay for return postage charges if no fault is found. - No credit shall be allowed for goods until they have been received complete. - A Full Credit will only be given on items returned within 30 Days from Purchase. - If a credit is to be given, the original shipping charges will not be refunded/credited. - This does not affect your statutory rights. 7. SHIPPING TRANSIT DAMAGE – What do I do if the package gets damaged on the way to me? Some products may be damaged during transit. Inspect all packages immediately in the presence of the delivery person. Do not sign delivery receipt until all packages have been inspected. In the event that damage has occurred, do not sign for the package. If a package is refused it must have considerable damage for a credit to be issued. 'Considerable damage' will be determined by AWI Styling . Refusing a non-damaged item will result in no credit being issued. Call AWI Styling within 24 hours to file a claim request. Failure to comply with this policy may result in a denial for damage claim. 8. INCORRECT SUPPLY – What do I do if you send me the wrong items(s)? If we supply the wrong item(s) for your vehicle then we will refund you the full cost of the part and cover all shipping/return costs and send you out the correct item(s). 9. WARRANTY/LIABILITY – What warranty do I get? AWI Styling does NOT offer a warranty in addition to a customers statutory rights, on any of the products sold. All products sold by AWI Styling are aftermarket products and are intended for off-road or show use only. AWI Styling is not liable for any damages or injury as a result of these products. Due to strict regulations by the Department of Transportation, some of these products are not approved for street/highway use. Removal of reinforcements, bumpers, indicators, and other safety equipment on the vehicle is the responsibility of the buyer. AWI Styling will not be responsible for your own actions. The buyer fully understands the risks associated with modification of the vehicle and AWI Styling will not be responsible for any damages resulting from the use of these products. All products are sold unpainted and unfitted. Products DO NOT come with headlights, sidelights or any other accessory items. Please ask confirmation at the point of order if you are not clear about what is supplied with a full kit or individual item(s) order. AWI styling does not accept any liability for third party fitting and cannot guarantee tolerance levels of the kit. Check the product when it is delivered. If the product has been damaged please notify us immediately on 07745549140 to determine if you are eligible for a refund. Once we have received the damaged part back we will dispatch a replacement. AWI Styling does not accept responsibility for damage caused to your car that may occur during the fitting process of these parts. The purchaser shall, unless otherwise agreed in writing, be responsible for all carriage, telephone, postal and other incidental charges incurred during the guarantee period. 10. FITTING OF STYLING ITEMS – PARTS MAY REQUIRE MODIFICATION! All styling kits are manufactured with 100% fiberglass (FRP – fibre reinforced plastic). Due to the material used in production, the body kit item(s) will NOT be a direct bolt-on. The body kit item(s) may require prepping, sanding, shaving, filling gaps, or other extensive body work. These modifications may include removal or cutting of the reinforcement bars. By accepting our terms and conditions of sale, the customer understands the procedure and possible difficulty in installing the body kit. We HIGHLY recommend that a professional body shop with fiberglass body kit experience perform the installation. Refunds will not be issued due to poor fitment or problems associated with the fitting of the body kit or item(s). AWI Styling cannot be held responsible for and costs incurred for storage, work quality or additional fitting work by your appointed fitter agent or body shop. PLEASE DO NOT book you car in for work to be undertaken until you have received your product item(s) from AWI Styling. 11. OUT OF STOCK – How long will it take to receive my order? If the item(s) is/are in stock, we will endeavor to dispatch it within 48 hours from receipt of receiving the cleared funds. Most styling orders take 7 to 10 days. In the event that there is a backorder the wait time may be 4 to 8 weeks although we do reorder stock on a monthly basis. There is a 25% cancellation fee on orders that are cancelled within 30 days of purchase date. 12. DESIGN VARIATION Whilst we make every effort to ensure that the goods supplied correspond to in every effect with the sample, specification or description provided as the case may be, AWI Styling is not responsible for the minor variations in specification in colour or other design features, and no such minor variation shall entitle the purchaser to rescind the contracts or shall be the subject of any claim against AWI Styling by the purchaser. 13. CONSEQUENTIAL LOSS The total extent of our liability to the purchaser for any default or breach whatsoever and howsoever arising shall in no case exceed the invoice value of the goods and AWI Styling shall in no circumstances whatsoever be liable to the purchaser in respect of any loss or damage whether suffered by the purchaser or any customer of the purchaser and whether direct, indirect, consequential, subsequential, or however else arising subject only to statute. 14. LAW If any part of these terms and conditions shall be found to be unlawful it shall not affect the validity or enforceability of the remainder of the conditions.
